BirdiePole Privacy Policy

BirdiePole is operated by Fairway Signal LLC. This Policy explains how we handle information through BirdiePole.com, the BirdiePole app, our course-camera service and related services (the “Services”). The Services are intended for adults age 18 and older in the United States.

Effective as of September 13, 2026

1. Your golf experience

We use information to provide and improve your BirdiePole golf experience: connecting your shots to your account, delivering your footage, organizing your round history and keeping the Services reliable and secure.

Your recordings are private by default. We do not publish them or make them available to golf industry partners unless you explicitly choose to publish or share them. We do not sell personal information, individual location or Bluetooth histories, or identifiable recordings. Any commercial partner datasets we provide will contain aggregate statistics about groups, not individual golfer histories.

2. Information we collect

Account information

We collect account identifiers, name, email address and, when provided, phone number, profile information and age-eligibility confirmation. Clerk provides our account services. If you use Sign in with Apple, we receive the account information Apple makes available based on your choices.

Location and nearby-pole information

When you enable matching, we collect location coordinates, accuracy, timestamps and Bluetooth proximity information, such as nearby pole identifiers and signal strength. Your phone may also broadcast a matching identifier to nearby BirdiePole equipment. This information helps identify your course and connect recordings to the correct account. Matching may operate in the background while enabled. Turning off matching or withdrawing device permission stops future matching collection through that feature; it does not automatically erase records already collected.

Recordings and golf information

Course cameras capture video and audio. We process and store recordings, thumbnails, shot and course information, scorecards, favorites and any outfit description you provide to deliver and organize your footage. Other people may appear in course recordings. Course capture does not require access to your phone’s camera or microphone. Saving a video to your photo library requires your action and the applicable device permission.

Notifications

If enabled, we use a push-notification token to send service messages, including when footage is ready.

Purchases

Apple processes App Store payments. We receive transaction identifiers, products, purchase and expiration dates and verification information to manage access and restore purchases. Apple does not provide us with your full payment-card number.

Service use and diagnostics

We collect information about use of the Services, such as app and operating-system versions, device or installation identifiers, event and request identifiers, network information, playback activity and errors. Some records may be associated with your account, a shot or a recording. We use these records to operate, troubleshoot, secure and improve the Services.

Communications

We receive messages, contact information and attachments you send us, as well as feedback and content you choose to submit or publish. We use this information to respond, provide support and administer the Services. Promotional emails, if sent, include an unsubscribe method; essential account and service messages may still be sent.

3. How we use information

We use information to authenticate accounts; match, process and deliver footage; maintain libraries and round history; fulfill purchases; provide requested sharing; respond to support requests; investigate errors and misuse; and comply with applicable law.

Authorized personnel may access recordings and related information when needed to support you, verify matching, investigate a problem or improve BirdiePole’s recording, processing and delivery services. Internal improvement does not authorize selling identifiable footage, providing it to partners for their independent use, or using it in BirdiePole advertising without your separate permission.

Individual location and Bluetooth records support the matching and delivery service and associated troubleshooting. They are not products we offer to golf industry partners. We may derive aggregate course-activity statistics as explained below.

4. Aggregate statistics

We may create aggregate statistics about golf activity, scoring and performance. These describe groups and are processed so they cannot reasonably be linked to an individual or household. Examples include course activity during a period or how often golfers score par or better on a hole during a season. Small groups may be combined or omitted to protect privacy.

We may use these statistics and provide them to golf industry partners through licensing, sale or partnership agreements for research, benchmarking and product development. These datasets do not include account identifiers, contact details, individual location histories or identifiable recordings.

Creating and using qualifying aggregate statistics is part of the Services, rather than an optional analytics feature. We do not provide a separate preference to exclude activity from genuinely anonymous statistics. This does not waive any rights or consent requirements that apply to the processing of personal information. We honor applicable rights as described below.

We maintain aggregate statistics in non-identifying form, do not attempt to identify individuals from them and require recipients to maintain those protections and not attempt identification. Statistics already made anonymous may remain after your account is deleted because they no longer identify you.

5. Who receives information

Service providers

Providers help us operate the Services. These include Clerk for accounts; Apple for sign-in, payments and notifications; Cloudflare for network delivery and protection; PostHog for service analytics where configured; and contracted hosting and infrastructure providers. They may process information, including recordings where needed for hosting or processing, on our behalf and subject to restrictions on independent use. This processing is separate from licensing anonymous statistics to golf industry partners.

People you choose

A publication or sharing action authorizes us to make the selected content available to the audience or destination you choose. Public posts can be viewed, copied or redistributed by others. Copies saved or shared outside BirdiePole are subject to the recipient’s or destination’s practices. A recording is not automatically public because it was captured, matched or added to your library.

Legal and security needs

We may disclose limited information when required by law or reasonably necessary to protect people, investigate misuse or protect legal rights. We may transfer information in a merger, acquisition or transfer of the business, subject to applicable law and privacy protections. Any materially different use requires the notice and permissions applicable to that change.

6. Retention and deletion

Raw GPS and Bluetooth evidence in our active matching databases expires after seven days. Our scheduled cleanup removes expired records hourly while the service is operating, with catch-up cleanup after an interruption. Derived course visits, shot associations and round history are separate records used to provide your account features; they remain associated with your account until removed or the account is deleted. They are not anonymous simply because raw matching readings expire.

We retain your library recordings and personal round history while providing those features, until you request their deletion or delete your account. You can request removal of a particular recording or record at privacy@birdiepole.com. Shared recordings may require removing your association or editing the footage to protect another person’s rights; we assess removal requests involving identifiable content rather than treating shared footage as anonymous.

To request account deletion, open Profile → Delete Account or contact privacy@birdiepole.com. We verify requests as reasonably necessary, remove account-linked personal records and request deletion by relevant providers. Provider cleanup may continue after your account becomes unavailable. We do not retain identifiable footage indefinitely merely because we own rights in the recording.

Account-linked service analytics, including course-visit and shot events, are separate from raw matching evidence and are covered by our account-deletion process. Limited operational diagnostics, security, support, transaction and legal records may be retained where necessary for their stated purpose or required by law. Backup copies may persist until replaced or expired; restored systems must honor previously received deletion requests. These retained personal records remain protected and are not treated as anonymous statistics. Deletion requests do not remove copies independently saved by other people or content you transferred to another service.

Deleting your account does not cancel an Apple subscription. Manage subscriptions separately through Apple.

7. Your choices and rights

You can manage matching and notification preferences in the app and revoke permissions in iOS Settings. Disabling a permission may prevent the related feature from working. It does not authorize us to disregard your choice. You decide whether to publish or share recordings.

Depending on applicable law, you may have rights to access, correct, obtain a copy of or delete personal information, and to restrict, object to or opt out of certain processing, or appeal our response. Contact privacy@birdiepole.com to exercise these rights or submit an appeal. We may reasonably verify your identity or an authorized agent’s authority. We will respond within applicable legal deadlines and will not unlawfully discriminate against you for exercising a protected right.

We do not sell personal information or share it for cross-context behavioral advertising. Nothing in these Terms or this Policy limits a right that cannot lawfully be waived. Qualifying anonymous statistics are distinct from personal information subject to those rights.

8. Adults only

The Services are for people age 18 and older. We do not knowingly permit minors to create accounts. If you believe a minor has provided personal information, contact privacy@birdiepole.com so we can investigate and take appropriate action. This age restriction does not mean a minor could never appear incidentally in course footage; contact us about footage involving you or your child.

9. Security and location of processing

We use reasonable administrative, technical and physical safeguards to protect information and restrict access to its authorized purpose. No system is completely secure. We investigate security incidents and provide notices required by law.

Information may be processed on servers and by providers away from the golf course, including in the United States and other locations where our providers operate. We do not represent that all processing stays on the course or that BirdiePole cannot access individual records.

10. Changes and contact

We will update the effective date when this Policy changes and provide appropriate notice of material changes. Where required, we will obtain additional permission before applying a new use to personal information. A policy update does not by itself authorize incompatible use of previously collected information.
